Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and BLOCKXS, Südstr. 58, 58509 Lüdenscheid, Germany ("Hustlr.io", "we", "us"), governing your access to and use of the Hustlr.io websites, game and related services (the "Services"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility & Accounts

• You must be at least 16 years old, or have the consent of a parent or legal guardian, to use the Services.
• You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
• You may register with a username and password or via a supported third-party sign-in provider (e.g. Google). You must provide accurate information and may not impersonate others.
• Accounts are personal to you and may not be sold, traded, gifted or shared.

2. License to Use the Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial entertainment. All rights not expressly granted are reserved by BLOCKXS.

3. Virtual Items & Currency

• The Services may include virtual currency (e.g. coins, in-game cash) and virtual items (e.g. vehicles, property, boosts). These are licensed, not sold: you receive a limited license to use them within the Services only.
• Virtual currency and items have no real-world monetary value, are non-refundable except where required by law, and may not be exchanged, sold or transferred for real money or value outside the Services.
• We may modify, rebalance, or remove virtual items and currency at any time as part of game operation and balancing.
• For purchases, applicable statutory withdrawal rights for digital content apply; by starting the download/use of digital content immediately, you acknowledge your right of withdrawal may expire as permitted by law.

4. Community Rules & Prohibited Conduct

You agree not to:

• Cheat, exploit bugs, use bots, macros, automation, or unauthorized third-party software that modifies or interferes with the Services;
• Harass, threaten, defame or abuse other players, or post content that is illegal, hateful, sexually explicit, or otherwise inappropriate;
• Attempt to gain unauthorized access to accounts, servers or systems, or disrupt or overload the Services (e.g. DDoS);
• Buy, sell or trade accounts, virtual items or currency for real-world value;
• Reverse engineer, decompile or extract source code or assets, except where permitted by mandatory law;
• Use the Services for commercial purposes, advertising or data scraping without our written permission.

5. User Content

You may create or submit content in the Services (e.g. chat messages, buildings, custom designs, usernames) ("User Content"). You retain ownership of your User Content, but grant us a worldwide, royalty-free, sublicensable license to host, store, reproduce, display and distribute it for the purpose of operating, promoting and improving the Services. You are responsible for your User Content and confirm you have all necessary rights to it. We may remove User Content that violates these Terms.

6. Moderation, Suspension & Termination

• We may warn, mute, suspend or permanently ban accounts that violate these Terms, with the severity depending on the violation.
• Upon termination for breach, licenses to virtual items and currency end and no refund is owed except where required by law.
• You may delete your account at any time. We may terminate or discontinue the Services (in whole or part) with reasonable advance notice.

7. Intellectual Property

The Services, including all software, graphics, game design, characters, music, and the Hustlr.io name and logo, are owned by BLOCKXS or its licensors and are protected by copyright, trademark and other laws. You may not use them except as allowed by these Terms.

8. Disclaimers

The Services are provided "as is" and "as available". We do not guarantee that the Services will be uninterrupted, error-free or available at all times; online games evolve, and content, balance and availability may change. Statutory warranty rights under German law remain unaffected.

9. Limitation of Liability

We are liable without limitation for intent (Vorsatz) and gross negligence (grobe Fahrlässigkeit), and for injury to life, body or health. For slight negligence, we are liable only for breaches of essential contractual obligations (Kardinalpflichten), limited to the foreseeable damage typical for this type of contract. Liability under the German Product Liability Act remains unaffected.

10. Changes to these Terms

We may amend these Terms for valid reasons (e.g. legal changes, new features). We will notify you of material changes in advance via the Services. If you do not object within the stated period or continue using the Services, the amended Terms apply. If you object, we may terminate the agreement with reasonable notice.

11. Governing Law & Disputes

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protection provisions of your country of residence remain unaffected. The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
